LEGAL NOTICE AND CUSTOMER AGREEMENT

By accessing this website, creating an account, submitting an order, or purchasing from All The Things Sunshine (“Store,” “we,” “us,” or “our”), you acknowledge that you have read, understood, and agreed to this Legal Notice, our Shipping Policy, Refund Policy, Privacy Policy, and Terms of Service.
1. PRODUCT INFORMATION
We make reasonable efforts to display and describe our products accurately. However, colors, packaging, designs, measurements, textures, styles, and other details may vary slightly because of screen settings, manufacturing changes, supplier variations, or the handmade or mass-produced nature of certain products.
Unless expressly guaranteed in the product listing, specific colors, styles, characters, scents, designs, or mystery-item variations are not guaranteed. Product photographs may contain props or multiple items for display purposes; the written product description identifies what is included with the purchase.
We reserve the right to correct typographical errors, inaccurate descriptions, pricing mistakes, inventory errors, or omissions and to cancel or refund an affected order when necessary.
2. PRODUCT SAFETY AND USE
Customers are responsible for reviewing all product descriptions, labels, ingredients, age recommendations, warnings, and manufacturer instructions before use. Products must be used only as intended.
Some products may contain small parts, fragrances, adhesives, food ingredients, latex, chemicals, or other materials that could present choking hazards, allergic reactions, skin irritation, or other risks. Children must be supervised by a responsible adult. Products labeled as toys, slime, putty, squishies, novelty items, collectibles, or sensory items are not intended for consumption unless the listing expressly identifies the item as food.
Discontinue use immediately if irritation, damage, or an unexpected reaction occurs. All The Things Sunshine is not responsible for harm resulting from misuse, failure to follow warnings or instructions, unauthorized modification, improper storage, lack of supervision, or use inconsistent with the product’s intended purpose.
3. THIRD-PARTY PRODUCTS
All The Things Sunshine may resell products manufactured, branded, or distributed by third parties. Product names, trademarks, characters, and logos belong to their respective owners. Their appearance on our website does not imply sponsorship, partnership, or endorsement unless expressly stated.
Manufacturer warranties, when available, are provided by the manufacturer and are subject to that manufacturer’s terms.
4. ORDERS AND PAYMENT
Submitting an order is an offer to purchase and does not guarantee acceptance. We may refuse or cancel an order because of suspected fraud, payment failure, inventory errors, pricing mistakes, shipping restrictions, abusive conduct, or other legitimate business reasons. If we cancel an order after payment has been collected, the appropriate amount will be refunded to the original payment method.
Customers are responsible for providing complete and accurate billing, shipping, and contact information. We are not responsible for delays, losses, or additional expenses resulting from information entered incorrectly by the customer.
5. SHIPPING, DELIVERY, AND LOST PACKAGES
Customers are responsible for shipping charges unless a promotion expressly states otherwise. Processing and delivery estimates are not guaranteed delivery dates.
Once an order is transferred to the shipping carrier, delivery timing may be affected by carrier operations, weather, holidays, emergencies, address problems, or events outside our reasonable control. Customers must promptly report missing, damaged, or incorrectly delivered packages and cooperate with any carrier investigation or claim.
An order shown as delivered by the carrier will be treated as delivered unless evidence establishes otherwise. This provision does not eliminate any rights available under applicable law or an approved shipping-protection program.
6. RETURNS, REFUNDS, AND CANCELLATIONS
Returns, exchanges, refunds, and cancellations are governed by our separately posted Refund Policy. Certain products may be final sale when disclosed in the product listing or Refund Policy, subject to applicable law.
Unauthorized returns may be refused. Shipping charges are nonrefundable except when required by law or when the Store determines that an error occurred on our part.
7. PAYMENT DISPUTES AND CHARGEBACKS
Customers agree to contact All The Things Sunshine promptly at [INSERT STORE EMAIL] to attempt to resolve an order concern before initiating a payment dispute.
We reserve the right to provide order records, tracking information, communications, policy acceptances, photographs, and other relevant evidence to banks, payment processors, carriers, or governmental authorities when responding to a dispute or suspected fraud.
Knowingly submitting false information, falsely claiming nonreceipt, or attempting to retain both the merchandise and refunded funds may constitute fraud. We reserve all lawful rights and remedies concerning fraudulent transactions.
8. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, products and website content are provided “as is” and “as available,” without warranties or representations beyond those expressly stated in writing. We do not guarantee that every product will satisfy every customer’s personal preferences or expectations.
Nothing in this Legal Notice excludes or limits warranties, remedies, or consumer rights that cannot legally be excluded.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, All The Things Sunshine and its owner, employees, representatives, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products.
Where liability cannot legally be excluded, our total liability relating to a purchase will not exceed the amount the customer paid for the product giving rise to the claim, except where a greater remedy is required by applicable law.
This limitation does not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other legally non-waivable conduct.
10. INDEMNIFICATION
To the extent permitted by law, customers agree to be responsible for claims, damages, or reasonable expenses resulting from their unlawful conduct, misuse of products, violation of these terms, or infringement of another person’s rights.
11. INTELLECTUAL PROPERTY
Store photographs, written descriptions, graphics, branding, logos, and original website content may not be copied, reproduced, republished, distributed, or used commercially without prior written permission from All The Things Sunshine, except where permitted by law.
12. GOVERNING LAW
This agreement is governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute shall be handled in a court with lawful jurisdiction and proper venue, subject to any consumer rights that cannot be waived.
13. SEVERABILITY AND CHANGES
If any provision of this Legal Notice is found unenforceable, the remaining provisions will remain in effect. We may revise these terms periodically. Updated terms become effective when posted and apply prospectively, except where otherwise required by law.
